Happy New Year and Welcome 2021! As we cross the threshold to a new year, there is cautious optimism that it will indeed be happier than the last. I am sure that I echo the sentiments of many when I write that I am excited to turn the page on what has been an incredibly challenging year toward a hopeful and much more positive 2021. I am honored to serve as your Chapter President for 2021 and look forward to working with the entire CAI-NJ membership as we navigate through the coming year together. Through the efforts of our capable and innovative office team led by Executive Director Angela Kavanaugh, our dedicated Board of Directors and our committed committee chairs and vice-chairs, our chapter has remained a steadying and important presence for our entire membership. We will look to focus the chapter’s efforts on providing news and updated information and education to the membership and utilizing our leverage as needed to advocate on behalf of our homeowner leaders, managers and business partners on issues impacting common interest communities throughout the State. One way the Chapter continues to advocate on behalf of all members is our con- tinued support of the New Jersey Political Action Committee (NJ-PAC). On December 16, 2020, the NJ-PAC held a successful “Holiday Beer & Cheer Tasting” – a virtual interactive pairing event with craft beer and chocolate and a discussion about the beers and how to serve, taste and enjoy them which raised $2,137.26 on behalf of the NJ-PAC. We look forward to holding more events for NJ-PAC in 2021. Continuing “Our Virtual Community” While we are looking ahead to planning in-person networking events at the appro- priate time, the Chapter will start the year with some wonderful events planned as a virtual community. We will be continuing our informative webinars and virtual roundtables, which will include a focus on news and legislative developments. Our next virtual New Jersey-Legislative Action Committee Roundtable will be held on Wednesday, January 13, 2020 from 12:00 pm - 1:30 pm. They will discuss issues such as Immunity legislation for CICs, Appeal of Radburn Regulations, Statute of Limitations on construction defects in CICs, Regulation of smoking/vaping of cannabis in CICs, and board member training. I urge you to attend this important discussion led by the NJ-LAC. Please check your inboxes for registration information. In continuing with the virtual theme of last year’s Conference and Expo, with the new year comes the roll out of the chapter’s virtual expo live stream sessions. From 9:30to 10:30 a.m. every Tuesday and Thursday through April, members will be able to live stream with between five to six exhibitors each week about the products

S uch a simple thought and yet so encouraging. A full year to make it right and set the world back on track. To me, every day is a gift. Consider it a new beginning and draw as much as you can out of the day that you were fortunate to be given. January is a time to reflect and come up with a plan on not what we can acquire or how much richer we can become but instead how we can become better, less selfish, more giving and more forgiving, starting with improving ourselves to be better people… So, make plans and press restart. My wish for all of you is to have the most amazing year ever! This month’s theme is ‘Our Virtual Community’. I hope that you take advantage of everything the chapter has to offer. The Exhibitor Video catalog is currently available on our website and we are excited to launch the second piece of our annual tradeshow, the Exhibitor Live Stream Sessions that will run from January through March 2021. Here you will have the opportunity to come face-to-face with exhibi- tors as you enter their LIVE ZOOM ROOMS. Exhibitors will offer education, games, great giveaways, and Q&A on issues and what their company offers. Free registration for the Live Stream Sessions is available now on our website, www.cainj.org, but you must pre-register for each date to participate. Continuing Education Credits — Now more than ever, managers can earn credits online through our virtual educa- tion. Credits are available for both webinars and roundtables. The Wednesday Webinar Series will start up again in April 2021. All members may attend the one-hour sessions, hosted by the CAI-NJ Ultimate Partners, on topics that are timely and relevant to those living in common interest communities. We

welcome topic suggestions so please contact me if there is a topic that you would like the chapter to present. Virtual Roundtables, hosted by the Manager and Homeowner Leader Committees, as well as sessions from our Legislative Action Committee, will be presented throughout the year. Each session will cover five related topics of interest to our members. Our first LAC Roundtable will be on Wednesday, January 13th from 12 pm – 1:30 pm. The topics that will be discussed on this roundtable will be: Immunity legislation for CICs, Appeal of Radburn Regulations, Statute of Limitations on construction defects in CICs, Regulation of smoking/vaping of cannabis in CICs, and board member training. LEGISLATIVE UPDATE

T he beginning of a new year is a good time to review the purpose and mission of CAI’s Legislative Action Committee-NJ (LAC), and to report to you our leg- islative and regulatory priorities for the upcoming year. Looking back to when I wrote my January 2020 Legislative Update column, little did we know what was soon to occur that would change our lives so drastically, from the oncom- ing pandemic and resulting lock-down, to the publishing of the Radburn election and meeting regulations, to a tumultu- ous national and local election season. But we persevered and are now prepared to start anew in 2021. As you know, our committee members are dedicated vol- unteers who donate their time and talents to achieving our goal of improving the lives of our community association members and empowering the professionals and business partners who work every day in the field of common interest community management and governance. There are homeowner leaders, community managers, insurance specialists, attorneys and accounting professionals on the LAC, each bringing their own expertise, experience and knowledge to our efforts to impact legislation to benefit our constituents. The LAC’s stated purpose and mission is to allow “CAI to speak with one voice on legislative and regulatory matters that affect community associations, community association managers and CAI business partners.” Technically, the NJ LAC is a committee of CAI’s national office in Washington that serves the State of New Jersey, which is also served by two CAI chapters, the NJ Chapter and the Pennsylvania/ Delaware Valley Chapter. We review all pending legisla- tion that could potentially impact our constituents and report our support (or opposition) to New Jersey’s legislators. We also initiate legislation and regulatory changes to address issues faced by our constituents for which there is no current remedy. If you are reading this column you likely either live or work in a common interest community. You are

our “eyes and ears” on the ground and we depend on you to report to us the issues you face and the problems you need solved. Our effectiveness as a group depends in part on your willingness to partner with us in our efforts. We need your input! Our legislative and regulatory priorities for the balance of this legislative term (January 2020 to January 2022) include: • Passage of legislation to provide common interest communities immunity from COVID19 claims (to protect against uninsured claims arising from exposure to the novel coronavirus — A4979) • Pursue the appeal of the DCA’s Radburn regulations (regarding election and meeting proce- dures – currently pending in the NJ Supreme Court) • Adoption of a legislative correction of the Palisades statute of limitations ruling (which provides that this time frame runs from the date a construc- tion defect is discovered, even if the developer/builder is in control of the Board at the time — S396/A4903) • Adoption of an amendment to the Municipal Land Use Law with regard to bonding of association improvements (currently not required of developer/builder if improvements are to be dedicat- ed to the association) • Monitor prospective legislation dealing with Board Member training and Manager Licensing • Adoption of uniform common ownership interest legislation (the revival of UCIOA by the NJ Law Review Commission — S2261/A4265) Our efforts will be focused here, and we will not let up until we’ve achieved the success, and fairness, our con- stituents deserve. T o say 2020 was difficult would be an understatement. The year brought many challenges to the fulfilling the goals of CAI-NJ and providing the membership with opportunities to continue their education and provide networking experiences. The chapter’s team was tasked with creating a new way of participation in CAI-NJ which naturally evolved into virtual programming. Wednesday Webinars The biggest accomplishment was the Wednesday Webinar series, with twenty consecutive weeks of a webinar series presented by the CAI-NJ member partners, including the Ultimate, Elite and Premier Partners. The series featured three to four companies who spoke on various topics to provide our members with incredible knowledge, as well as the opportunity for managers to earn one credit hour weekly for their professional designations. This series fulfilled 20 hours of education credit opportunities. O nline voting saves time and increases efficiency for all parties involved. The entire lifecycle of an election can be handled online, getting rid of the need to send ballots out to community members, eliminating the wait on getting them back, reducing follow-up commu- nication, and working to get maximum voter participation. Most online voting platforms have similar capabilities and support the self-management of elections as well as man- aged election services. With managed election services, all aspects of the voting process, including setup, post-vot- ing reporting, verifying, and delivering certified results are managed by the election service provider. Due to the Radburn Law Regulations in New Jersey and the need for maintaining voters’ anonymity, there are bene- fits to engaging a third-party provider to maintain a layer of separation between the voting process and the individuals involved. With fully managed election services, the task of setup and administration is taken off the shoulders of property managers, giving them more time to focus on the immediate needs of their community. B y now, most everyone has heard about the Radburn legislation, which was signed into law by Governor Christie on July 13, 2017. What you may not have known is that until the Radburn legislation became effective, there was no specific statutory authority in New Jersey regarding electron- ic voting for community associations. The Radburn legislation authorized community associations to utilize electronic voting procedures: (1) when the board determines to allow voting by such means; and (2) when an association member consents to cast a vote electronically. Please note, however, that electronic voting does not mean that an association can just accept ballots by e-mail or other electronic means. Rather, ballots must be cast on-line or through another electronic means and be delivered directly to an association through a website or other secure service. In addition, authorizing electronic voting in an association will require implementing a specific electronic voting procedure, which may necessitate amending an association’s by-laws and/or adopting a resolution to allow voting by electronic means. You may have also heard that the Radburn regulations were issued by the Department of Community Affairs and made effective on May 18, 2020. These regulations now require that all voting in community association elections must be conduct- ed anonymously. Since these regulations are now controlling, you may be asking how electronic vot- ing is compatible with anonymous balloting. Well, the Radburn regulations specifically address this issue and authorize electronic voting so long as the election process is administered by a “neutral third party” to maintain anonymity. Community associations that are interested in implementing electronic voting should consult with their association’s counsel to discuss options for meet- ing these statutory and regulatory requirements. n

This allows the property manager, board members, and other stake- holders to gain first-hand experience of the online election process and helps to identify any modifications that need to be made to the ballot before it is made public to the voters. Internet Voting

Voters arrive at the association’s branded voting website and are instantly authenticated. If the voter hasn’t yet voted, a tamper-proof electronic ballot will appear. Once the ballot is completed, the voter may review their ballot prior to final submission. When the voter submits a ballot, the results are encrypted and kept anonymous. The voter is issued a receipt, which allows them to verify their vote was cast and they are now blocked from voting for this election again. As voting pro- ceeds, the election manager can send out reminder emails to voters and provide property managers with reports on turnout in real-time. Other Integrated Voting Methods Communities that are not tech-savvy sometimes require a combination of voting methods for their elections. In such cases, some providers offer integrated services like mail-in ballots, tele- phone voting, or kiosks to make the process easier. Certified Results Real-time data is available as an election progresses and results are ready within minutes of the end of an election event. Depending on the election platform, results can be posted to the association’s election website or emailed to the entire com- munity. In addition, the election services provider can issue a Letter of Certification certifying the election results.

S ince March 2020, our world has been turned upside down. As community managers, we have many night meetings for which would normally attend in person. This all changed as clubhouses, and all other facilities were shut down due to the COVID-19 pandemic. Our first challenge as a state, finding toilet paper and paper towels, followed by how to manage our private life and

accounts may be needed? How to efficiently schedule these meetings? Following these and many more questions, the next task was familiarizing managers, board members and residents with this new method of meeting. In some communities, an increase in attendance was seen. In other communities, such as our age-restricted communities, there were challenges, as not all residents had the technology needed to participate. Annual meetings, as we all know, can be a challenge in the “normal” world we knew. Elections have many moving parts, including multiple ways to submit your vote. The virtual world quickly limited these options. Additionally, during this time the New Jersey Department of Community Affairs (DCA) issued new regulations pertaining to elections. This added another interesting challenge to the annual meeting in the virtual world. How would these new regulations, such as the requirement for the ballot counting to be viewable by the membership, be addressed in the virtual world. For smaller communities, voting could take place the evening of the meeting. For larger com- munities, a separate meeting may have had to be scheduled

work-life as they were forced into one space. The next step was to quickly figure out how we could still con- duct meetings, given the new environment.

Association attorneys were contacted for recommendations on conducting virtual meetings. Most attorneys recom- mended adopting a resolution that would allow boards to conduct business virtually. Management companies, as well as managers, then needed to figure out: What platform to use? Who was covering the cost? How many

to allow members to watch the appoint- ed judges count. To the credit of the quick-thinking members of our industry, we found solutions to keep the business of our communities moving forward. Our jobs at this point have become more complicated. Between the contin- uous need to become educated on the ever-changing laws, through executive orders, preparing recommendations for our boards, and then educating those boards, our communities have need- ed us more than ever before. As an industry, we have stepped up to this challenge and written the handbook to operate within a pandemic. It is fair to say that the virtual meetings have been met with both embrace and opposition, however, this newly created form of meeting, forged in an unfortu- nate situation, is a new norm. n
