T his month’s theme is “Disaster Response” and as I sit here and write my President’s Corner, North Jersey is experiencing its first significant snowstorm! Being proactive for an anticipated disaster such as a snowstorm, tropical storm, etc. will alleviate a lot of headaches. Let’s be honest, any type of storm is no fun for a manager or home- owner, but like one of my old bosses told me when I was managing, “As a manager, this is what separates us. How you prepare and communicate before, during, and after the storm, is what will set you and us apart.” I remember when I was managing, we had a 30-inch storm that took us all by surprise. Being visible and getting back to residents during the storm, helped with some of the anxiety and stress they were dealing with. As many of you saw in January when I-95 in Virginia was at a standstill for over 20 hours due to snow and accidents, it left drivers with no gas, heat, food, or blankets. If this taught us one thing, create an Emergency Car Kit. Here are a few items to consider: • Cell phone, portable charger, and extra batteries • Items to stay warm such as extra hats, coats, mittens, and blankets • Windshield scraper • Shovel • Battery-powered radio with extra batteries • Flashlight with extra batteries • Water and snack food • First aid kit with any necessary medications and a pocket knife • Hazard or other reflectors • Bright colored flag or help signs, emergency distress flag, and/or emergency flares • Road maps Be safe this winter! Prepare and deliver! Over the next 12 months I am going to be highlighting one person in our chapter each month who had a huge impact on my life both professionally and personally. February’s Impactful Leader Marie Mirra, CPA, PCAM Marie founded Mirra & Associates LLC, a Certified Public Accounting Firm in 2003. She has three decades of experience in servicing associations in all aspects of Common Interest Realty Associations (CIRAs). Marie served on the Board of Directors for the New Jersey chapter of the Community Associations Institute (CAI-NJ) during the years 2009 through 2014 and was President in 2014. Over the past years, she has served as Chairperson and held various positions on other CAI-NJ committees.

Groundhog Day – February 2nd. As I’m writing this, Groundhog Day is still a few weeks away but I’m hop- ing that Phil doesn’t see his shadow this year! Groundhog Day was celebrated for the first time on February 2, 1887, in Punxsutawney, Pennsylvania, thought up by a local newspaper editor Clymer Freas, who collaborated with a group of groundhog hunters, known as the Punxsutawney Groundhog Club. We now recognize the day as when the Groundhog comes out of his burrow after hibernating during a long winter to look for his shadow. If he sees it, he regards it as a sign of six more weeks of bad weather and returns to his burrow. So, if the day is cloudy and shad- owless, he takes it as a sign of Spring and stays above ground. Ironically, we wish for that day to be with no sunshine in hopes that Punxsutawney Phil or Staten Island Chuck, if you are a New Yorker, won’t be frightened and we will be able to enjoy Spring sooner rather than later. February Events. Plans for 2022 are underway and February will be filled with events and education. On February 1st, we will be hosting the first Virtual Legislative Roundtable Discussion of the year. Members of the Legislative Action Committee will lead a discussion, informing attendees on issues affecting those living in common interest communities through- out New Jersey. The topics will include Building Safety, COVID -19 Immunity, Statute of Limitations on Construction Defect Claims, Remote Annual Meetings, Board Member Training and Manager Licensing. This program will offer managers 2 continuing education credit. If you miss the live session, it will be available on the member-only page of our website, https://www.cai-nj.org/event-4635942 . On February 16th, Brown & Brown Insurance of Lehigh Valley will lead a discussion on Insurance Claims and Denali Property Management, Inc. will discuss, Managing Association Budgets in the Wake of Unexpected Costs, at the next Virtual Wednesday Webinar. W e start January with some good news and some bad news. It is traditional to start with the bad news. In that connection, we are very frustrated that the Legislature did not approve an extension of immunity for COVID -19 related claims for common inter- est communities (CICs). The original bill was set to sunset on January 1, 2022. Starting at the end of the summer, we commenced an intense campaign to have the bill extended for another period of time. In connection with those efforts, we and our lobbyists met with numerous legislators, sent letters to the Speaker of the Assembly and President of the Senate, and issued several LAC alerts and calls for action. These alerts generated a tremendous number of respons- es which were so numerous that they overwhelmed the Speaker’s email system. Near the end of December, we were informed that the Speaker and the Senate President, together with the Democratic caucus, were all opposed to an extension of immunity. Essentially, we were told that they thought the first bill gave CICs enough “breathing room” to learn how to address the pandemic. It goes without saying that we dis- agree with their logic, as the issue of potentially uninsured claims remains unaddressed. Unfortunately, while we felt we had strong, equitable arguments for passage of the bill and even though there were tremendous efforts made on the part of both the LAC and CAI members to communicate their preferences to legislators, the legislature was unwilling to pass the bill. Further efforts at this point would be unavailing and could potentially damage our standing and credibility with the political leadership. However, we will continue to monitor the situation and press forward with future efforts if and when same becomes appropriate. With respect to the good news, the legislature passed our statute of limitations bill (S396) on the last day of the session, and we are optimistic that the Governor will sign

Ass’n, Inc. v. 100 Old Palisade, LLC, 230 N.J. 427 (2017), the New Jersey Supreme Court issued a ruling which upset the longstanding precedent that the statute of limitations on construction defect claims was “tolled” until transition to unit owner control. This decision has resulted in several adverse court rulings against CICs. However, we were successful in convincing Assemblyman Gordon Johnson and Senator Loretta Weinberg to push through the aforementioned bill, which states that the stat- ute of limitations on construction defect claims does not commence running until the owners control the board. In so doing, the LAC successfully fended off challenges from construction, developer, and insurance industry groups. In addition, we are pleased to announce that the Governor signed A5549 regarding remote membership meetings in non-profit corporations into law. You may be aware that emergency COVID -19 related legislation per- mitted meetings of members (such as an annual meeting and election) to be conducted remotely during a state of emergency. The new law, which the LAC supported, makes it permissible to have remote member meetings in the absence of a state of emergency. In closing, while we cannot win every legislative battle, the LAC continues to have substantial success in getting key pieces of legislation passed. n were all opposed to an extension of immunity.”

Jules C. Frankel Manager Education Assistance Program Community Associations Institute NJ Chapter 2022 PROGRAM
Jules C. Frankel was a long time member of CAI and was a key figure in the success and growth of our chapter. Jules was President of the New Jersey chapter in 2000. Jules also received the follow - ing awards from CAI-NJ: Speaker of the Year in 2003, Author of the Year in 2004 and the Jerry Fien Distinguished Service Award in 2015. Jules was inducted in the CAI-NJ Hall of Fame in 2003. Jules was a staunch advocate for manager education and training and was always willing to help with seminars and industry educational programs. The Jules C. Frankel Manager Education Assistance Program (MAP) was developed to assist New Jersey managers in the common interest community industry in furthering their educational and professional development goals. The MAP provides the opportunity to any CAI-NJ manager member in good standing to apply for a scholarship. CAI-NJ will provide a fifty percent (50%) reimbursement per course to selected managers for any of the 100, 200, or 300 courses offered by CAI. More than one award may be given per applicant. Jules C. Frankel Manager Education Assistance Program Community Associations Institute NJ Chapter GUIDELINES AND APPLICATION PROCESS
AWARD: • The MAP awards a deserving candidate $250 per course (100, 200 and 300 level courses) towards the PMDP course of his/her choice. More than one award may be given during a calendar year. • The Scholarship Review Group will award scholarships once per year no later than April 29 th , 2022. • Scholarships must be used for PMDP courses offered by any CAI Chapter or CAI National. All courses may be in person or online. ELIGIBILITY: • At the time of the application and the reimbursement, you must be a member in good standing with the Community Associations Institute and the New Jersey chapter of CAI. • You must have attended at least 2 CAI-NJ events during the last 12 months. (in-person or virtual) • You may be asked to provide a follow up piece that will be printed in the Community Trends ® magazine that summarizes your experience with the MAP and the ways that it has allowed you to advance your professional goals. CAI-NJ reserves the right to modify any content prior to print. DEADLINES: • All applicants must submit entry no later than March 31 st , 2022 in order to be considered for a scholar - ship award. Selections will be made no later than April 29 th , 2022. PROCESS: • Interested candidates must fill out the attached application and answer the questions for review prior to dates. All entries must be typed and complete to avoid disqualification. Entries must be mailed to the chapter office or printed to PDF and emailed to info@cainj.org. • Anonymous essays are evaluated and award recipients will be selected by the Scholarship Review Group. Should there be a conflict on the committee (meaning that a company representative is evaluating an entry for the same company), that committee member will remove themselves from the process and not participate in the review/selection of the candidates. Since this is an anonymous process, the Chapter Executive Director will inform the Scholarship Review Group members of the conflict. • Selected managers must submit verification of course completion to the CAI-NJ office within 30 days of conclusion of the course to receive the scholarship reimbursement. • All classes must be completed by December 31 st , 2022. I t’s easy to forget the plan when everything is well and good. However, this past year has reminded us of the importance of having a plan in place when “it” hits the fan. In this article, we’ll go over some of the causes of loss in a natural disaster, what you can do to prepare, and what the claims process will look like should you have to file a claim.

Flood Flooding can be caused by heavy rain, rising sea levels, fast-melting snow or even tsunamis, cyclones and hurricanes. Specific insurance criteria needs to be considered in a flood. Many areas are not considered flood zones but may get flooded in a natu- ral disaster. To be considered a flood for insurance purposes, it must fit the description, which you can assess alongside your insurance advisor Sewage Backup Clogs, build-ups in pipes from grease, or improperly flushed items, such as paper towels or single-use wipes, are common causes of sewage backup. Although sewage backup is typically covered under your property insurance, you need to make sure you have proper limits in place. Ask your insurance advisor for guidance. Fire Firesareclassifiedby theEnvironmental Protection Agency as natural disasters. Also consider the potential for light- ning strikes, explosions, and burst gas lines to impact your condo association. Make sure you work with your bro- ker on a natural disaster preparedness plan and have steps lined up with a remediation company. Know when to call the remediation company from a claims perspective and make sure they know to be on standby for you in the event of a disaster. Many insurance companies can help formulate a written plan with ser- vice provider contact info, emergency contacts (i.e., fire, police, and EMS), a remediation company, your insur- ance broker, census forms or a listing of the number of occupants in each
unit and building, and website and communication tools for email and phone blasts. They’ll also make sure your service provider is lined up and has a plan for your property already, knows where to park equipment and vehicles, knows where the utility shut offs are, has predetermined a staging area for debris, has pre-contracted for dumpsters for debris, and has made arrangements to store additional mate- rials wherever possible and desired. Steps to File a Disaster Claim 1) Have pictures of the association before the disaster happened. 2) Contact proper authorities first — police, fire department, remedia- tion company. 3) Contact the broker to report the claim. a) All emergency repairs are acceptable and required. The goal is to keep the exist- ing damages from becom- ing worse. Pieces of all items that are repaired or replaced should be kept for the adjust- er to inspect. Pictures should also be taken immediately. 4) Claim is reported to the carrier by the broker. 5) Insured will hear from an adjuster within 1-2 business days. 6) An independent adjusting firm is assigned to inspect the property. If needed, additional contrac- tors will inspect the property. For example, an engineering compa- ny and/or a general contractor. 7) The independent adjuster will put together a report and estimate
