T his month’s theme is “Going Green in Your Community.” I think the focus on sus tainability and going green is stronger than ever. You not only see it in the com mercial market, with emission and conservation mandates expected by 2025, but the residential market is also jumping in. Most states, if not all, offer rebates and incentives for electric vehicles, new construction being built to high energy standards, rebates for energy efficient appliances, and lighting. Being a janitorial company, I thought I would share some benefits of green clean ing with our members. A pril is one of my favorite months. April Showers Bring May Flowers so don’t fret about the rain, but instead, focus on the season when the bulbs begin to bloom, and the birds migrate north in search of food and nesting when the weather finally warms. Let us also remem ber Earth Day, which this year is April 22nd. A worldwide event, raising awareness of the environmental issues which face all of us living on this precious planet, Earth. It is an opportunity to remind us all to do our part, by recycling and trying to have better energy efficient communities. G reen energy legislation is a hot topic in the New Jersey Legislature. Of particular interest to common interest communities (CICs) are various bills relating to electric vehicle (“EV”) charging stations. As many of you are aware, in October 2020 Governor Murphy signed into law an amendment to the Planned Real Estate Development Full Disclosure Act codified at N.J.S.A. 45:22A-48.4. In essence, this law requires CICs to permit owners to install an EV charging station in a parking space that is for the exclusive use of that owner unless such an installation would pose a life-safety risk. The law includes various protections for CICs, such as homeowner insurance and indemnification requirements, and requires the owner to pay all costs of installation and removal, including costs incurred by the CIC in reviewing any plans or specifica tions. Significantly, the law also empowers boards to install common area communal EV charging stations and to cre ate new parking spaces to accommodate the same. In addition, NJ A2360 was signed into law on January 18, 2022, which requires electrical utilities to charge the residential rate for electricity used in CIC EV charging stations unless a different rate is agreed upon by the CIC pursuant to a commodities contract. Notwithstanding the aforementioned laws, we have not experienced a flood of owner applications to install charging stations, likely due to the expense entailed in doing so. However, we have seen many CICs install ing community charging stations and in so doing taking advantage of various sources of external funding, such

For example, in July 2021 New Jersey adopted N.J.S.A. 40:55D-66.20. This law provides that as a condition of site plan approval for multi-family developments with more than 5 units (including CICs), a certain number of charging stations must be planned for and installed. Considering environmental concerns and oil prices, we expect this trend to accelerate. Pending legislation includes tax incentives for installation of charging stations and fleet conversions to EVs (S429) and additional budgetary allo cations towards station installations. The LAC is proud to support EV charging station initiatives that provide benefits to CICs and which further the environ mental concerns of the residents of our state. n as PSE&G’s EV commercial/multi-family charging pro gram which provides direct funding for the installation of charging stations to multi-family properties.

New Jersey COMMUNITY POOLS — What’s in Store for 2022? By Benjamin Basch, American Pool Enterprises

T he snow piles at the end of the parking lots have melted away, spring is in the air, and community residents are looking forward to the 2022 pool sea son. The 2020 summer saw most community association pools in New Jersey remain closed over liability concerns, but with cover from the state’s common interest community immunity bill, the majority of pools reopened for 2021. Even though the state’s immunity bill expired at the time of this writing, the 2022 trend appears towards reopening versus additional restriction. Here is some insight into what communities can expect this pool season. This is the third pool season since the pandemic began, and while the community pool remains a much-deserved fresh air respite for many, it is also a challenge for those charged with working out the details of safe operation. Even though the state’s operational restrictions evolved into “best practices” as of July of 2021, it is still anything but business as usual for those preparing to operate pools this summer. The headwinds for swimming pool operations are the same issues all businesses are facing throughout the coun

try. However, the way these national chokepoints impact the pool in their neighborhood may not be obvious to all. Here are some ways pandemic-related stressors are shap ing summer 2022 along with some insights that can help you navigate this pool season. Awareness of the challeng es can certainly help community association managers and boards make better decisions in planning for the summer. Labor From full-time associates to seasonal supervisors and lifeguards, pool companies are operating in a tight labor market. The hope is that with the expiration of enhanced unemployment benefits, higher vaccination rates, and reduced community spread, more people will be motivated to return to the workforce. The hiring of lifeguards has been affected in an outsized way and it will probably take several years to recover. Here is why. ber of lifeguards entering the market has been significantly reduced in the last two years. The industry counts on lifeguards working not just for a season but to return for at least three seasons. This means there are fewer guards available to return to the job since they may have entered the workforce in some other line of work. Pool companies are now also com peting with work that can be done remotely, and lifeguarding remains a job that requires that person to show up poolside! Although technology has advanced, it has yet to find a way to perform a rescue of a guest in distress by Zoom or text. You have seen it all over the media and probably in your own work place. Existing and new workers are demanding improved working con ditions. With unemployment as low as it is this certainly has the attention of business leaders right now. The lifeguard job requires specific skills and a base fitness level not to mention over thirty hours of training to earn a certification. Furthermore, hot, long days poolside can be physically and mentally demanding in ways those enjoying the air conditioning all day cannot quite understand. Supply Chain Disruption The pool business depends on chem icals and equipment to operate and maintain facilities safely. Disruptions seen across all industries remain a pool oper ator’s constant frustration. Community association pools may feel the supply chain disruption in longer lead times

and more expensive repairs. In-season pool closures waiting for repair parts are far more common now. Over the last year, the industry has seen chemical shortages and price spikes. Items that are used regularly may be hard to get or require substi tutions. This all affects how and when pool companies can solve a mechan ical issue at the pool. If a repair part is not available, the company may need to replace an entire component or do additional plumbing to make an alternative pool pump fit into the filter system. The cost of chemicals and supplies is rising in a way that cannot be predicted at the moment. Expect to see quotes with time and materials la carte and with short expiration dates. Otherwise, contractors may find a profitable job become a dog as a function of delayed approvals. Securing your pool vendor by the end of each calendar year is a healthy way to prepare for the next season. Last year many communities who wanted to “leave their options open” ended up left in the cold for the pool season. Earlier decisions allow your pool professionals more time to recruit and hire on your behalf. It also allows them to better plan for operations and have the confidence to bring in appropriate inventories. When it comes to repairs and ren ovations, leave extra time for work to be done. honesty about these unusual times versus magical thinking about how things should be or used to go a long way. Realistic expectations result in faster and better solutions for everyone. Statements like “I don’t care how you do it but just get it done today!” are not constructive. Pool companies have seen a lot of success with com munities sharing our lifeguard recruiting assets with their communities. Pool companies should be working to make the application and training process as smooth as possible to maximize the effectiveness of recruiting efforts. LOVE YOUR LIFEGUARDS Drop the “sheesh … kids today…” mentality and accept that we are in new times with new challenges. In terms of attracting and retaining the best staff, a vibrant guard culture is essential to building a lifeguard team. Making lifeguard training easy to join and even free to candidates goes a long way in eliminating obstacles for certification. It is easy to criticize, but when is the last time you com plimented the lifeguards working your pool. A positive approach to the guards helps make your facility a place

business loves making “spring magic” and opening pools with big problems right on schedule, but times are different now. If you have a repair, you know needs to be done, get on it outside of the pool season if you can so that it doesn’t impact your resident’s season unexpectedly. Proactive repairs versus running to a point of failure can also help increase facility uptime. Consider modifying pool hours and dates to reduce the number of manhours to cover your pool. This will save the community money, optimize resources, and deliver a more consistent pool season. PARTNER WITH YOUR POOL PROFESSIONALS We are all living in the same wild world together, so it makes sense to work together for mutual success. How can you do this? Maintaining good faith and open communi cation throughout the season allows for better teamwork when the inevitable snags occur. Maintaining intellectual
