October is My Favorite Month! October brings the beautiful colors of the Fall season and the brisk air that always puts a spring in my step. It inspires optimism, which is critical these days. The quote above seems perfect for this season — and truly reminds me to appreciate the beauty of nature, the amazing family and friendships I have, and my many blessings. Join me in celebrat- ing this beautiful month and enjoying incredible optimism for the future! It’s Conference Time!! A year ago, we could have never envisioned the conference without the excitement of the gathering — table after table adorned with beautiful colors, products, and incredible spirit. The convivial experience of spending time with friends, colleagues, and clients may be different this year, however, we are committed to making this experience a memorable one. This year’s video catalog and live streaming events will allow us to spend time with each other in today’s virtual world. Please look for more details in this issue of Community Trends ® . What Else is New in our Virtual World? Our CAI-NJ Team has been working hard to keep our membership connected. Our Webinar Wednesday educational programs have been incredibly successful. It’s been a pleasure to tune in each week and listen to the leaders in our industry discuss topics relevant to our common interest communities. Our networking pro- grams continue to be popular as well. The new HOA Feud has been a lot of fun, with business partners and managers competing each week. We are grateful to our F.A.S.T. Committee for hosting the Make-A-Wish Tricky Tray. Their efforts will be truly meaningful as 100% of the proceeds will be donated to the Make-A-Wish Foundation. New programs are being developed and sponsored by many of our committees in the coming months….so stay tuned and stay connected! Advocacy – What’s New? The LAC (Legislative Action Committee) continues to work diligently on behalf of our common interest communities. There are many critical legislative priorities right now — so please read George Greatrex, Esq.’s article for additional insights and updates. Let us also remember the incredibly important work of the PAC (Political Action Committee) since they provide financial support for the LAC to help advance the chapter’s interests on a state-wide basis. day, Make-A-Wish New Jersey grants children life-changing wishes for those battling critical illness in the Garden State. The September 17th event raised $3,640 for this wonderful cause. 2020 Virtual Conference & Expo, will launch on Monday, October 5th, releasing the first industry group of the video catalog. An additional segment will be released weekly. Be sure to use this as your go-to resource when shopping for vendors and management companies. Additionally, the Exhibitor Live Streams launching later this year, will allow you to visit 150 profes- sional companies, learn about the latest trends in communi- ty association services and gather advice from our experts. The post COVID-19 party is currently scheduled for April 2021, followed by the Awards Celebration, Golf Outing, Olympics, Beach Party, Annual C&E, Pre-Conference Party and a new event, the Winter Break Party. Focus on the Future: Advocacy, Education and Resources

The theme for this year’s Conference & Expo, echoes the chapter’s mission statement — CAI-NJ is dedicated to enhancing the quality of community association living through education, legislative advocacy, shared resources and professional development. We also help our members stay abreast of the current news, laws and issues affecting community associations in the State of New Jersey. The chapter is here to serve you and I am excited to share an update of what is currently available as well as a sneak peek into the chapter’s future. Advocating for ourmembers— Our LAC (Legislative Action Committee) is constantly monitoring legislation impact- ing our common interest communities, those communities in which many of you reside. By donating to CA-PAC, you can assist our LAC in supporting and educating our state legislators. I suggest reading George Greatrex, Esq.’s article on page 8 for an update on the bills that LAC is currently monitoring as well as the status of CAI-NJ’s appeal to the DCA “Radburn Law” Regulations. Wednesday Webinars — weekly sessions where you can tune in and learn about important issues affecting your business or common interest community. These educational sessions are led by our partners, experts in their field, sharing their knowledge. Member managers are eligible to earn one CEU credit for every session attended. Networking Events to help you make new connec- tions in the industry while catching up with colleagues that you have missed. Join in for a fun half-hour for the HOA Feud where our business partner members duke it out with managers for bragging rights to be the weekly winners. I would like to thank our F.A.S.T. W elcome to the 2020 Conference and Expo issue of Community Trends ® ! This is the most widely distributed and read issue of the year for our monthly magazine. Like everything else in our world in 2020, this year’s Conference and Expo will be differ- ent… meaning virtual… but no less valuable for all of us who live and work in common interest communities here in New Jersey. For those of you who don’t receive this magazine, or don’t faithfully read it when it’s delivered to your office or computer, this Legislative Update column serves as a monthly report on the status of CAI’s efforts to initiate and support legislative and regulatory efforts that will improve the quality of life for the nearly 1.5 million residents living and working in New Jersey’s 6,700 common interest communities, and to oppose those efforts which would do them harm. In the January 2020 issue of Community Trends ® , I reported on the Legislative Action Committee’s priority list of issues on which we planned to focus our efforts during this legislative session (January 2020 to January 2022) in Trenton. They included: • Adoption of uniform common ownership interest legislation (the revival of UCIOA by the NJ Law Review Commission) • Adoption of a legislative correction of the Palisades statute of limitations ruling (which provides that this time frame runs from the date a con- struction defect is discovered, even if the developer/ builder is in control of the Board at the time) • Adoption of an amendment to the Municipal Land Use Law with regard to bonding of association improvements (currently not required of developer/builder if improvements are to be dedicat- ed to the association)

“...this year’s Conference and Expo will be different… meaning virtual… but no less valuable for all of us who live and work in common interest communities here in New Jersey.” • Monitor Radburn regulations to be published by the DCA (regarding election procedures and by-law amendment procedures) • Monitor prospective legislation dealing with Board Member Training and Manager Licensing It is an understatement to say that much has occurred since I wrote that column in January that has necessarily diverted our attention and focus. Those issues include: • The advent of the COVID-19 pandemic and the Governor’s issuance of various Executive Orders shutting down the state as a means of slowing the spread of the virus: We have focused on interpreting and applying those EOs, and at times sought clarification from the Governor’s Office when such interpretation was difficult if not impossible CONT I NU E S ON PAGE 40 • Expansion of services to be reimbursed to associations or performed by municipalities (such as maintenance of fire hydrants) • Monitor DCA adoption of revised language further defining “adequate reserves” and “benefits derived” (as contained in PREDFDA and the Condominium Act and their administrative regulations)

A lbert Einstein once said that “In the middle of difficulty lies opportunity”. This year has certainly seen its share of difficulties, but as we (hopefully) come out the other side of one of the most significant human and economic events of our lifetime there are countless lessons to be learned and an abundance of opportunities, perhaps greater than in any time now referred to as “pre-COVID”. From quarantine and remote learning for school children to new Radburn Regulations courtesy of the NJ Department of Community Affairs and too many Governor’s Executive Orders to count, it has been quite a challenging year of learning to adapt and acquire new skills to navigate personal relationships and com- munity management in a virtual world. While managers were still adjusting to remote work arrangements, and in many cases in the role of teachers navigating the new world of remote learning since March, every community manager in New Jersey was faced with the challenge of learning a completely new pro- cess for elections and meetings thanks to the DCA’s updat- ed Radburn Regulations. Forget everything you thought you knew, everything you had learned over many years of professional education and on the job training, everything changed. Just like that. And thus, began the manager’s education revolution of 2020. Several industry attorneys led the way with webinars and virtual seminars to help managers and communities get equipped to deal with the new government mandates relating to Radburn. It was no-doubt overwhelming in those first few weeks but what we saw come out of that time was perhaps the most prolific advancement of manager education ever. Industry professionals and business partners found a way to connect with managers while we couldn’t get together as we had before. Online seminars, webinars, and of course virtual happy hours became the “new” nor-

mal and, seemingly overnight, managers had more oppor- tunities for continuing education than ever before! In the early weeks of summer, when it became evident that things were not going back to the way they were any time soon, companies re-evaluated, re-aligned and re-fo- cused on not just “dealing” with the circumstances at hand but rather seeing the opportunities presented to become catalyst of change. CAI-NJ has been an incredible resource for managers and all industry members throughout the pandemic. From Cyber Trivia presented by the F.A.S.T Committee with trivia and networking for a good cause, to the critical LAC (Legislative Action Committee) updates and the latest Webinar Wednesdays, CAI-NJ has brought our community together while we are apart. The first ever CAI-NJ Virtual Conference and Expo will assuredly be no different. We don’t quite know what to expect, but we are excited about it! NEW HOUSING REPORT SHOWS 73.9 MILLION AMERICANS RESIDE IN HOMEOWNERS ASSOCIATIONS AND CONDOMINIUM COMMUNITIES

9/22/2020 — Falls Church, VA — More Americans live in community associations today than ever before, according to new research published by the Foundation for Community Association Research. The 2019-2020 National and State Statistical Review for Community Association Data shows that 73.9 million Americans, or roughly 27% of the U.S. population, now live in a home- owners association, condominium community, or housing cooperative, collectively referred to as community associa- tions or planned communities. The annual Statistical Review is produced in conjunction with Community Associations Institute (CAI), the leading international authority in community association education, governance, and management. For more than 40 years, the Foundation has published the National and State Statistical Review for Community Association Data as part of the Community Association Fact Book. The report is the only one of its kind—using American Community Survey

(ACS) and American Housing Survey (AHS) data to better align state-level community association research. According to the new report, based on data collected in 2019, California now leads the nation with 49,200 associations. Florida has the second most associations with 48,500, followed by Texas (21,000), Illinois (18,800), North Carolina (14,100), and New York (14,000). Lasty year, there were roughly 351,000 community associations in the U.S., and the Foundation estimates that number in 2020 has grown to between 352,000 and 354,000. Community associations have been growing consistently and successfully for decades. The overwhelming majority (89%) of homeowners and condominium association res- idents rate their overall experience living in a community association as “very good” (40%), “good” (30%), or “neu- tral” (19%), according to results from the 2020 Homeowner Satisfaction Survey, also produced by the Foundation. value of homes in community asso- ciations is nearly $7.2 trillion, and roughly $96 billion in assessments is collected annually from homeowners to fund essential maintenance. Since its inception, this exclusive report by the Foundation has been sourced by community association stakehold- ers — homeowners, board members, and management professionals as well as attorneys, accountants, developers, mortgage lenders, federal agencies, and public officials—all who work with the Foundation and CAI to build better communities. The report details top reasons for the growth of community associations: • The value of collective man- agement. Americans largely have accepted the collective management structure of community association living, where association boards are composed of democratically elected homeowners who voluntarily serve their communities. The research shows there are 2.4 million commu- nity association board and commit- tee members in the U.S. performing 86.7 million hours of volunteer ser- vice annually. • Privatizing public functions. With many local municipalities fac- ing fiscal challenges, communi- ties often are developed with the stipulation that the builder create an association that will assume many responsibilities that tradition- ally belonged to local and state government (e.g., road mainte- nance, snow and trash remov- al, and stormwater management).

According to the report, 77% per- cent of new housing built for sale is in a community association—with homeowners contributing $27.4 billion to association reserve funds for the repair, replacement, and enhancement of common property (e.g., swimming pools, elevators, and resurfacing streets). • Expanding affordable hous- ing. There has been a consistent effort to increase the percentage of homeowners in the U.S., and since the 1960s, condominiums have tended to serve as lower-cost entry housing, especially for first- time homebuyers.
