I t’s finally here, our largest event of the year, the 2019 CAI-NJ Annual Conference & Expo! I am so excited about the Expo this year. First of all, I love the logo and theme. I really think it covers what the Expo is all about, whether it be getting the right vendors for your community’s needs or the nec- essary education so boards can effectively run their associations. Secondly, it is the first time we had the booths sold out by May. That’s never happened before. Thanks to the success of last year’s Conference & Expo and the
hard work of Angela and the C&E Committee we did not have to make a single phone call. In addition, this year we have hired a PR firm to really help us get the word out to as many community board members as possible. They have different social media platforms that they will be using, and I am sure that they will be able to increase the attendance this year.

Speaking of education, the topics this year are excellent and timely, please make sure you attend all of them. The first one covers keeping open lines of communication and dealing with burnout in the workplace. Although very dif- ferent, both are extremely important in this is world of social media and instant responses that we live in. The second session at 10:45am covers maintenance, what the association is and is not responsible for, and what could happen if you do not build a winning team. The speakers are excellent and bring with them a wealth of knowledge and expertise, each one of them having been in the industry for many, many years. And then of course we have the LAC update in the afternoon. Boy, do they have a lot to talk about! The committee sure has been busy and there are lots of changes that Boards need to be aware of. This session is definitely one worth attending. Last, but not least, are all the prizes. Between the cash CAI is giving away and the drawings at each booth, there is at least $10,000 to be won. How can anyone say no to that? Can’t wait to see you all at The Event Center @IPA on October 17th! n

T here is nothing more exciting for me than attending the CAI-NJ Pre-Conference Networking Party and the Annual Conference and Expo. Every year in this issue I encourage all of our Homeowner Leader members to attend. Also, along with attending, I strongly suggest that they invite their committee members, and just as important, their key management team members. I can assure you that if your management team attends, your community will not cease to function and I can also assure you that by them attending the conference, they will bring back invaluable industry knowledge along with creating dozens of key contacts with our exhibiting business partners. All of the major players will be exhibiting and even if you’re not looking to replace a current vendor, when and if the time comes that you need to make a change, you will already have an idea of where to turn. Please consider this year’s theme, “Building a Winning Team with CAI-NJ”. You really can’t build a winning team if you leave your MVPs (management and maintenance staff) at home. W elcome to the 2019 Conference and Expo issue of Community Trends ® ! This is the most widely distributed and read issue of the year for our monthly magazine. For those of you who don’t receive this magazine, or don’t faithfully read it when it’s delivered to your office or computer, this Legislative Update column serves as a monthly report on the status of CAI’s efforts to initiate and support legislative and regulatory efforts that will improve the quality of life for the 1.35 mil- lion residents living and working in New Jersey’s 6,700 common interest communities, and to oppose those efforts which would do them harm. In the February issue of Trends I reported on the Legislative Action Committee’s priority list of issues on which we will be focusing our efforts during this legislative session (January 2018 to January 2020) in Trenton. They include: • Mortgage foreclosure reform (to address the plague of vacant and abandoned homes in foreclo- sure — known as “zombie” foreclosures — A2085/ S1243). In May we achieved success when a package of foreclosure reform bills was passed by the legislature and signed into law by the Governor. Among other things, these reforms strengthened the enforceability of association liens for unpaid assessments and related charges, and shortened the time period within which a Sheriff’s Sale must be conducted on a foreclosed prop- erty. • Expansion of services to be reimbursed or performed by municipalities (such as mainte- nance of fire hydrants — A1745/S2774). We have motivated sponsors shepherding this bill through the legislature. • Adoption of uniform common ownership interest legislation (the revival of UCIOA by the NJ Law Review Commission – A3851/S2425). These bills seek to begin the process of consolidating into one
omnibus statute the many statutory and regulatory provi- sions that apply to the various forms of common interest communities in our State. It has already overwhelmingly passed the Senate and we are hopeful it will pass the Assembly and move on to the Governor’s desk before the end of the year. • DCA adoption of revised language further defining “adequate reserves” and “ben- efits derived” (as contained in PREDFDA and the Condominium Act and their administrative regulations which primarily apply to new developments still under developer control). We have worked collaboratively with the NJ Builders Association to draft proposed revisions to the DCA regulations that address these important regu- lations, and have submitted those revisions to the DCA. We are optimistic that those revisions will be favorably reviewed by the DCA and reflected in their final rules. • Opposition to legislation limiting a Common Interest Community’s ability to include pro- tective indemnification provisions in vendor contracts (such as snow removal contracts – A3968/ S665). We continue to oppose this legislation that would protect snow removal vendors, at the expense of community associations who hire them. Other issues have arisen during this year that have also demanded our attention, and we will focus on ensuring the legislation and regulations aimed at addressing these issues will benefit common interest communities in New Jersey, or at the very least do no harm to them. They include: • Release of DCA “Radburn Law” Regulations: In early June of this year the Department of Community Affairs (DCA) issued a set of new administrative regula- tions meant to interpret and apply the various elements of the 2017 Radburn election law. This law included various amendments to the PREDFDA and Condo Acts as they relate to voting and elections in common inter-

Your LAC has carefully reviewed and analyzed those proposed regula- tions and found that while some are helpful and acceptable, many are problematic and some downright unacceptable. The LAC has submit- ted a letter to the DCA outlining our concerns with each of those many problematic and objectionable pro- posed regulations, and it is our hope that those concerns will be satisfac- torily addressed by the DCA in the final regulations before they become law. • Electric Vehicle Charging Stations: (A1030/S2421) Advancing “green energy” technol- ogy brings with it both benefits and complications, and this topic is a good example of that. Legislative efforts to promote the use of electric vehicles are underway, and the LAC is working with the sponsors and proponents of this legislation to ensure that the benefits to the users of such technology don’t also burden the common interest communities that would be the subject of laws. • Statute of Limitations for claims against developers: A New Jersey Supreme Court opin- ion in the case of The Palisades at Fort Lee Condo. Municipal Bonding Requirements – (A1425, S3233) - Last year, the legislature passed a law removing developers’ requirements to post performance and maintenance guarantees on construction not ultimately dedicated to the municipality. While intended only to apply to shopping centers, CA-PAC is concerned that our communities could be swept into the exemptions, and will be working to correct the oversight. Delinquencies and Expedited Foreclosures – (A2085, S1243) – We continue to attempt to work with the banks to maintain vacant units and assume responsibili- ty for maintenance fees while pushing for rent receiverships as an option. Municipal Services / Fire Hydrant Maintenance - (A1745) – CA-PAC is advocating for expansion of the municipal services provided to your community. Our top priority for now is passage of legislation that would ensure that your local municipal utility authority keep your neighborhood safe by properly maintaining fire hydrants, and we hope to make the cost of such maintenance fair by banning the practice of charging our associations more than their host municipalities. Electric Charging Stations - (A1030) - There is National and State legislation concerning the installation of electric charging stations for existing and future common interest communities. CA–PAC will be there to make sure you have say over when, where, and if to include these stations in your communities. DCA Inspections - (S1150) - This bill would reduce inspections from every 5 years to every 2 years. Solar Panel Installations – (A2469) - Recent legislation proposes controls for regulation and installation of solar panels in your community. Insurance Deductibles – (A2439) - Recent legislation proposes to prevent an association’s ability to transfer the responsibility for a damage claim’s deductible to homeowners in condominium associations. Snow Contractor Indemnification – (S665) - This legislation would require snow contractors to be indemnified for any damage or injuries as a result of their snow removal/ice control operations.

Having been on this committee since 2014, I am so grateful to have been the Committee Chair this year. I would like to thank the committee members who have all worked very hard alongside me and volunteered their time to organize the details of this year’s event. The committee has taken into account all of your feedback from our inaugural event and incorporated it into improved coordination for our second year at this venue. There will be a new layout and format this year, and attendance will once again be free for property managers and homeowners. The New Jersey Chapter of the Community Associations Institute is dedicated to enhancing the quality of community living through education, legislative advocacy, and professional development. Our theme for this year’s event is all about building your TEAM – Training, Education, Advocacy, Management.
