For that reason, New Jersey legis lators must strongly consider carving association maintenance fees and assessments out of both the new home stead exemption and the enlarged personal-property exemption. These charges are already secured by a statutory lien on the unit; exempting them would prevent the proposed law from shifting a debtor’s obligation onto everyone else in the community without undercutting the bill’s broader consumer-protection goals. The Bills Current Status. A-3538 was introduced and referred to the Assembly Financial Institutions and Insurance Committee on February 5, 2024. While movement has been slow since then, because of the bill’s potential implications, it is one to watch. n
