The only exception to the rule is for non-competes entered into in connec tion with the sale of a business. On July 3, 2024, in the case Ryan, LLC v. FTC the U.S. District Court for the Eastern District of Texas issued an injunction prohibiting the enforcement of the ruling against the Plaintiffs in that case and determined that the plaintiffs would likely be able to estab lish that the FTC did not have authority to establish the rule, and that the rule was arbitrary and capricious. That court has indicated that it will determine whether a nationwide injunction against the rule should issue by August 30, 2024. n
