EDUCATION SESSION 1 Oh, “Tutti Frutti”, Rock your Understanding of Fiduciary Duty! - Discuss the concept of fiduciary duties, what they mean, how they apply in the association governance setting, what the legal obligations and consequences are surrounding upholding vs. breaching fiduciary duty, and examples of how the various duties apply in real-life examples. Focus will be placed on the applicability of fiduciary duty to board members and community managers in the context of everyday business decisions. However, while that may remain true, insurance carriers are now using reserve studies to properly assess the risk profile of communities. In the session we will discuss how the reserve study is utilized by brokers and carriers to address the physical property’s state and condition and why doing such has a direct implication on your insurance renewal outcome. We will discuss the findings of the Foundation for Community Association Research (FCAR) on rising costs and insurance coverage trends, current pending or potential Reserve Study requirements as well as the impact of deferred maintenance on insurance and the importance of risk mitigation.
