Boards should strictly follow the procedural requirements for elections set forth in the association’s governing documents, particularly with respect to qualifications of candidates, notice of meetings/elections, voting eligibility, format of ballots and tabulation pro- cedures. Furthermore, boards should consult with legal counsel to make sure the association’s election protocols are consistent with the New Jersey Condominium Act, the Planned Real Estate Development Full Disclosure Act (PREDFDA), the Radburn Regulations, the New Jersey Nonprofit Corporation Act and all other applicable laws.
