Use Municipal Engineer and Building Code Officials as a Resource If a smaller community hires a tran- sition engineer with a somewhat nar- rower scope of work in order to save costs, the association board and its engineers should consider using munic- ipal representatives as a resource to gain free leverage over the sponsor/ developer. The association should file a request under New Jersey’s Open Public Records Act (“OPRA”) for a copy of any Developer’s Agreement between the sponsor/developer and the municipality and carefully review it to make sure the sponsor/developer has complied with all of its obligations therein.
