persons.” However, in December 1995, the FHAA was amended by the Housing for Older Persons Act of 1995 (HOPA), which eliminated the “significant facilities and services” required to qualify for the exemption. HOPA retains the requirement that housing must have one person who is 55 years of age or older living in at least eighty percent of its occupied units. Once an age-restricted community satisfies either of the following require- ments: (1) all residents are 62 years of age or older; or (2) at least eighty percent of the occupied units include one resident age 55 or older, then the community can proceed with creating its own age restrictions in compliance with state and municipal law.
