In many cases, HOAs will have to intervene regardless of who is responsi ble for the costs associated with reme diation and restoration. For example, there was a property in Burlington County where the upstairs unit owner did not fix an ongoing leak in her fau cet, which resulted in microbial growth in the downstairs unit. After several attempts for the downstairs unit owner to address the concerns with the upstairs owner, the HOA had to intervene. With the assistance of the HOA’s insur ance agent and attorney, remediation specialists along with a plumber were given access to the upstairs unit to fix the faucet leak. Concurrently, the HOA investigated the bi-laws to identify who was liable. Ultimately, the HOA assumed responsibility for the reme diation and restoration costs and as subrogated (seek reimbursement) from the upstairs’ property owner’s insurance carrier. Overall, mold growth can come from various causes/sources, can be hidden or exposed, and can cause health concerns. Therefore, it is import ant that HOAs stay on top of mold issues in both common area as well as in individual units. The sooner mold issues are discovered and addressed, the less damage it will cause and be less expensive to remediate. n
