online training module to meet the minimum requirements to all common interest community (CIC) board members at no-charge. In fact, CAI-NJ already offers board members and homeowner leaders the voluntary Board Leadership Development Training class at no charge. The NJ-LAC has previously engaged with the bill Sponsor and various other key legislators regarding this issue and has drafted revised legislation. In the event that the bill moves forward, the NJ-LAC will pursue amendments to the bill as articulated above. A1699 – Manager Licensing The manager licensing bill (A1699) would require any community managing entity, whether that be a manage ment company or individual, to obtain licensing to provide management services to communities. The licensing struc ture would be both established and enforced by DCA, with potential fines up to $4,000 per each unlicensed man agement agreement. These fines would apply to contracts executed after the bill’s enactment. Similar to the Board member training bill, the NJ-LAC would work to draft a bill that removes the authority over

The DCA would also have to determine how to handle reporting and tracking of the training and whether atten dance at past CAI regulated training programs would provide credit under the new training protocols. While NJ-LAC supports training requirements, it is con cerned that having the DCA oversee the program might have a negative effect on board member volunteers and their willingness to serve on boards. While the DCA serves an important purpose in our industry and provides many protections to communities, there is concern that it does not have enough staff with subject matter expertise on many of the topics that the training program will encompass. In addition, the proposed legislation grants the DCA rule making authority which could have an adverse impact, as excessive training requirements may make it more difficult to recruit volunteers to serve on boards. CAI-NJ has instead proposed that it is in a much better position to provide this training and oversee the crediting requirements of the bill. CAI-NJ has stated that it is prepared to provide an
