W OW, it’s CAI-NJ’s 40th Anniversary and there is much to celebrate. Throughout the year, the chapter presidents were asked to reflect on the chapter’s beginnings and how far we’ve come in our mission; to enhance the quality of community association living, through edu- cation, legislative advocacy and professional development. As the chapter’s 2018 president, I offer my reflections on the chapter’s past, present and future. • What is your most memorable moment with CAI-NJ? - Not a singular moment, rather it’s the camaraderie amongst the members that I hold in my memory. • What has your experience as chapter president been like? - I’m the current chapter president. As the chapter president, I have the honor of working with a mem- bership that is professional and extremely dedicated to making positive strides in our industry; whether it’s better educational classes or more opportunities for growth in our industry. The level of volunteerism is remarkable. • How has CAI-NJ impacted your career and professional development? - When our firm first entered the industry, we were embraced and encouraged by the leaders of CAI-NJ. - These leaders were our mentors in the industry and showed us the value of CAI’s educational and advo- cacy programs. - These programs added value to our firm thereby facili- tating our growth by extending that value to our clients. • How and when did you get started in CAI-NJ? - I was a board member of my own community back in the 80's and I learned about the Annual Trade

Show from a fellow board member who was a CAI member. - I joined CAI as a manager member in the early 90's when I started our property management firm and became a member of the Legislative Action Committee (LAC). • In what ways has CAI-NJ grown over the past 40 years? - In the early 90's, our LAC was gaining progress on the legislative front. The result was passage of the Municipal Services Act, which eliminated “As the chapter president, I have the honor of working with a membership that is professional double taxation on condominium communities. Now, our LAC is on top of every bill that is being proposed and is an integral part of protecting our communities. - On the educational front, CAI-NJ relied on National for educational programs. Now, the NJ chapter is a leader on many positive initiatives which includes preparing and teaching courses to our NJ communi- ty managers and homeowner members. Based on my reflection, I believe, as a chapter, we have honored our mission and will continue to do so. I thank all those who have served our chapter in the past and look forward to mentoring the members of the future. LOOKING AHEAD LARRY THOMAS, PCAM | CAI-NJ CHAPTER EXECUTIVE DIRECTOR

F irst, I want to thank everyone involved in CAI-NJ for working along with me and allowing me to be a part of an organization that not only gives in so many ways but allows friendships to be created within our indus- try. CAI-NJ was formed back in 1978 and the individuals who formed this chapter were motivated and persistent in pursuing a goal of success for all of its members. I’ve recently had the privilege of sitting with Wendell Smith, our chapter’s first president and discussing the early days of CAI-NJ. At the end of the conversation, it was evident that the goals and aspirations are still the same today — educate our members, advocate for our industry and be the go-to resource for all our stakeholders. It’s an amazing story of how we’ve grown over the past 40 years. We are rapidly approaching the 2,000-member plateau and have gone from a part-time Executive Director to an office of four full-timers and three-part timers. The purpose of this article is to welcome everyone to this year’s Conference and Expo. We are excited about the new venue. Angela Kavanaugh and her Conference and Expo Committee have spent dozens of hours preparing for the event making sure that your day will be as beneficial as possible. Please make sure to take advantage of every-

thing that is offered, and who knows you may be one of the lucky $1,000 cash prize winners. I also want to remind everyone to encourage their col- leagues to attend. If you’re a board member, invite your committee volunteers and management and maintenance teams. If you’re a manager, persuade your board mem- bers to attend. Load up the car and make a day of it. W elcome to the 2018 Conference and Expo issue of Community Trends ® ! I’m told this is the most widely distributed and read issue of the year for our monthly magazine. For those of you who don’t receive this magazine, or don’t faithfully read it when it’s delivered to your office or computer (shame on you…), this Legislative Update column serves as a monthly report on the status of CAI’s efforts to initiate and support legis- lative and regulatory efforts that will improve the quality of life for the 1.35 million residents living and working in New Jersey’s 6,700 common interest communities, and to oppose those efforts which would do the opposite. Earlier this year I reported on the Legislative Action Committee’s priority list of issues on which we will be focus- ing our efforts during this legislative session (January 2018 to January 2020) in Trenton. They include: • Mortgage foreclosure reform (to address the plague of vacant and abandoned homes in foreclosure — known as “zombie” foreclosures - A2085/S1243). We are making progress and hope to soon have the pending bill in a form that will be acted on by the legislature and sent to the Governor for signature. • Expansion of services to be reimbursed or performed by municipalities (such as mainte- nance of fire hydrants - A1745/S2774). We have motivated sponsors shepherding this bill through the legislature. • Adoption of uniform common ownership interest legislation (the revival of UCIOA by the NJ Law Review Commission – A3851/S2425). This bill has been recently introduced by motivated sponsors who are seeking to begin the process of consolidating into one omnibus statute the many statutory and regulato- ry provisions that apply to the various forms of common interest communities in our State.

• DCA adoption of revised language further defining “adequate reserves” and “ben- efits derived” (as contained in PREDFDA and the Condominium Act and their administrative regulations which primarily apply to new developments still under developer control). We have worked collaboratively with the NJ Builders Association to draft proposed revi- sions to the DCA regulations that address these import- ant regulations, and have recently learned that the DCA is reviewing our proposals. We remain optimistic… “I recommend that you pick up and read the September issue of Community Trends ® , known as the ‘LAC Issue,’ to learn about these issues in more detail." • Opposition to legislation limiting a Common Interest Community’s ability to include pro- tective indemnification provisions in vendor contracts (such as snow removal contracts – A3968/ S665). We continue to oppose this legislation that would protect snow removal vendors, at the expense of community associations who hire them. Other issues have arisen during this year that have also caught our attention, and we will focus on ensuring the legislation aimed at addressing these issues will benefit common interest communities in New Jersey, or at the very least do no harm to them. They include: • Board member training: An effort is underway to introduce legislation that will mandate board member training for New Jersey’s common interest communities. The LAC is currently discussing the pros

and cons of such legislation, and working with the sponsor to draft a bill that will benefit but not overly burden our homeowner leaders. • Electric Vehicle Charging Stat ions: (A1030/S2421) Advancing energy technology brings with it both benefits and complications, and this topic is a good example of that. Legislative efforts to promote the use of electric vehicles are underway, and the LAC is working with the sponsors of this legislation to ensure that the benefits to the users of such technol- ogy don’t also burden the common interest communities that would be the subject of laws. • Statute of Limitations for claims against developers: A New Jersey Supreme Court opin- ion in the case of The Palisades At Fort Lee Condo. Assn. Inc. v. 100 Old Palisade, LLC, 230 N.J. 427 (2017) significantly shortened the period of time within which a new homeowner association could seek judicial redress from its devel- oper for design and construction defects. The LAC is seeking to ini- tiate legislation that would reverse the unfairness to all common inter- est communities resulting from this court opinion. I recommend that you pick up and read the September issue of Community Trends ® , known as the “LAC Issue,” to learn about these issues in more detail. CA-PAC WORKS HARD PROTECTING THE INTERESTS OF COMMUNITY ASSOCIATIONS

Municipal Bonding Requirements – (A1425, S3233) - Last year, the legislature passed a law removing developers’ requirements to post performance and maintenance guarantees on construction not ultimately dedicated to the municipality. While intended only to apply to shopping centers, CA-PAC is concerned that our communities could be swept into the exemptions, and will be working to correct the oversight. Delinquencies and Expedited Foreclosures – (A2085, S1243) – We continue to attempt to work with the banks to maintain vacant units and assume responsibili- ty for maintenance fees while pushing for rent receiverships as an option. Municipal Services / Fire Hydrant Maintenance - (A1745) – CA-PAC is advocating for expansion of the municipal services provided to your community. Our top priority for now is passage of legislation that would ensure that your local municipal utility authority keep your neighborhood safe by properly maintaining fire hydrants, and we hope to make the cost of such maintenance fair by banning the practice of charging our associations more than their host municipalities. Electric Charging Stations - (A1030) - There is National and State legislation concerning the installation of electric charging stations for existing and future common interest communities. CA–PAC will be there to make sure you have say over when, where, and if to include these stations in your communities. DCA Inspections - (S1150) - This bill would reduce inspections from every 5 years to every 2 years. Solar Panel Installations – (A2469) - Recent legislation proposes controls for regulation and installation of solar panels in your community. Insurance Deductibles – (A2439) - Recent legislation proposes to prevent an association’s ability to transfer the responsibility for a damage claim’s deductible to homeowners in condominium associations. Snow Contractor Indemnification – (S665) - This legislation would require snow contractors to be indemnified for any damage or injuries as a result of their snow removal/ice control operations.

A Message from Cheryl Rhine, CIC, CIRMS 2018 CAI-NJ Conference & Expo Committee Chair

T his year at our Conference and Expo we are celebrating 40 Years of Prime Time with CAI! I am truly honored to have served as the Chair this year and have the opportunity to work with such a wonderful group of individuals. This has been a very busy and exciting year for us. We started the year planning our event at a completely new venue and we are thrilled to be holding this event at the Encore Event Center at iPLAY America in Freehold. This new venue offers a state of the art exhibit hall, beautiful meeting rooms as well as an added fun factor that nowhere else has ever had before! The new venue is not our only big change this year. For the first time ever all property managers as well as homeowner leaders can attend the conference free of charge. This was a long term goal of the committee and we are so happy to see it finally come to fruition. In addition, the C&E committee has been very hard at work planning and coordinating the series of seminars and we are excited to be offering our first ever TED Talks as part of this year’s conference. The committee has put endless hours of time and thought into providing our CAI members with seminars on relevant topics of interest as well as a balance of exhibit floor time to benefit everyone from attendees to exhibitors alike. Our theme this year is inspired by CAI’s 40 Year anniversary and we look forward to seeing some throwback fun with an ode to the good old days of Prime Time TV! One thing we didn’t change is our very popular $1,000 an hour give-away so make sure you put in your extra ticket for your chance to win! We appreciate the insight from some of our partner committees that we also met with this year for some input to improve this year’s C&E. I hope that everyone benefits from the changes we have implemented and look forward to hearing your feedback. I hope to see you there. Have you increased your CAI Board Membership Yet?

L ast fall the CAI National Board of Trustees approved a change to the structure of community association board member membership to make increasing Homeowner Leader membership a priority. The CAI New Jersey chapter embraced this change and has experienced unprecedent- ed growth under the new program. CAI-NJ is proud to now serve over 1,000 Homeowner Leader members. The new program has made it much easier and more cost effective for entire boards to join at a new lower cost to the association. Homeowner Leader boards of three to fifteen members can sign up for CAI membership at the rate of $295 a year. This is a drastic savings from the old program where dues for a large board could exceed $1,000. Boards that join under the new program will receive access to members-only benefits, special events and educational programs tailored for community associa- tion board members and key volunteers, free admission to the Annual Conference & Expo and more. We encourage existing Homeowner Leader members to sign up every member of their board as well as all key volun- teers in order to make the most of the membership investment in CAI and the New Jersey chapter. There are many reasons why it is important to enroll your key volunteers along with your board members. You can educate your community leaders to build consensus with the board’s plans, get your committee chairs familiar with industry professionals, create a succession plan for your community association and more. Business Partner, Manager and Management company members can help promote the program by spreading the word to the community associations that they work and do business with. It is well known that it is easier to work with an educated and knowledgeable board.

Many of our community association members have not yet taken advantage of this new program. The 2018 Membership Committee, led by Lysa Bergenfeld, Esq. and Nikolaos Haralambopoulos, has worked hard over the past year to promote the program by reaching out to our member associations with information. Please support their efforts to grow the New Jersey chapter’s Homeowner Leader membership category by spreading the word about the new program when speaking with a member or non-member community association. We at CAI-NJ believe that these changes to the com- munity association Homeowner Leader program are very exciting and may open the door for many questions. Presenter: Mike Hoch, Executive Vice President, P. Cooper Roofing Mr. Hoch has been a roofer for over 30 years and has hands-on knowledge/experience with all roofing technol- ogies (EPDM, Shingles, TPO, Metal, Modified Bitumen etc.). Mr. Hoch not only works with 34 daily crews who service over 10 states, he is considered an expert on the Eastern U.S. region working directly with roofing man- ufacturers GAF, Versico (a Carlisle Company), Tamko, and more to design/build roof systems and provide ser- vice orientation for many building owners. Mr. Hoch has the expertise to provide building owners and managers with the knowledge of what are the appropriate roofs’ needs and cost-efficient solution(s) for their building(s). His expertise in forensic engineering and qualifications as a Senior Member of the National Academy of Forensic Engineers and a Diplomat Forensic Engineer has helped him successfully represent many community associations through litigations and mediations. Presenter: Matthew Z. Earle, Esq., Kates, Nussman, Ellis, Farhi & Earle, LLP Mr. Earle has extensive experience representing community associations and providing legal services relating to, among other things, transition, interpretation of governing documents, insurance issues, compliance with federal and state laws, advising boards on fiduciary duties, dealing with resident disputes, handling annual meetings and elections, and litigating construction defects. Mr. Earle serves on CAI’s Legislative Action Committee. Presenter: George C. Greatrex, Esq., Shivers, Gosnay & Greatrex, LLC Mr. Greatrex, CAI’s Legislative Action Committee Chair, is a partner at the law firm Shivers, Gosnay & Greatrex, LLC, in Cherry Hill, New Jersey. Most of his practice is devoted to community association law in the areas of residential and commercial planned unit developments. Mr. Greatrex earned his B.A. degree from Rutgers University and J.D. degree from Temple University School of Law. Presenter: Timothy Martin, Senior Associate, MBI Gluckshaw Mr. Martin focuses on legislative and regulatory affairs. He consults on healthcare issues including patient safety, access and quality of care, mental health and addiction treatment. He also manages issues concern- ing animal cruelty laws, municipal animal control and the regulation of shelters and pounds. In addition to his lobbying, Mr. Martin also provides event management services, helping his clients organize fundraisers for political action committees and candidates on both sides of the aisle and in all parts of the state. Prior to becoming a full-time government affairs agent, Mr. Martin interned in both the New Jersey General Assembly and the Urban League of Lancaster County, PA. Mr. Martin earned his B.S. from Millersville University.
